I do have a recommendation for you, but I am not confident that the Thule rack, # TH9058, will tilt down far enough to lower the tailgate on your 2007 Honda Element.

But take a look at the Kuat Beta bike racks such as # B202-2 for 2-inch hitches or # B202-114 for 1-1/4 inch hitches. These racks tilt down much further so clearance for the tailgate won't be a problem.
